These Terms of Use (“Terms”) govern your access to and use of the Arton website, platform, and services (collectively, the “Platform”), operated by Arton asia plt. (“Arton”, “we”, “us”, or “our”).
By accessing or using Arton, you agree to be bound by these Terms.
If you do not agree, please do not use the Platform.
1. Eligibility and Acceptance
1.1 You must be at least 13 years old to use Arton.
Users under 18 must have permission from a parent or legal guardian.
1.2 By using Arton, you confirm that you have the legal capacity to enter into this agreement under Malaysian law.
2. Use of the Platform
2.1 Arton provides an online platform for displaying artworks and offering art-based products.
Arton is not a traditional retailer and does not guarantee sales or exposure.
2.2 You agree to use the Platform only for lawful purposes and in compliance with:
- These Terms
- Our User Agreement
- Privacy Policy
- Community Guidelines
2.3 You must not misuse the Platform, interfere with its operation, or attempt unauthorized access.
3. User Accounts
3.1 Some features require account registration.
You agree to provide accurate and up-to-date information.
3.2 You are responsible for all activity under your account.
3.3 Arton may suspend or terminate accounts that violate these Terms or pose legal or security risks.
3. How We Share Your Information
All payments and payouts are handled by secure third-party payment providers.
Arton does not store full credit card numbers or banking passwords.
4. Intellectual Property
4.1 All platform content, branding, and system materials are owned by Arton or its licensors.
4.2 Creators retain ownership of their artworks but grant Arton a non-exclusive, worldwide, royalty-free license to:
- Reproduce and print the artwork
- Display and promote the artwork
- Produce and sell art-based products
4.3 Users may not copy, distribute, or exploit any content without authorization.
5. Orders, Payments, and Products
5.1 All prices, product details, and availability are subject to change.
5.2 Arton manages production and fulfillment through third-party partners.
5.3 Refunds, returns, or cancellations are subject to Arton’s Return & Refund Policy.
6. Prohibited Activities
You agree not to:
- Upload infringing, illegal, or offensive content
- Impersonate others or provide false information
- Conduct fraud, scams, or misleading transactions
- Use bots, scraping tools, or automation without permission
- Interfere with platform security or operations
7. Disclaimer of Warranties
The Platform is provided “as is” and “as available.”
Arton makes no warranties regarding uninterrupted access, accuracy, or suitability for any purpose.
8. Limitation of Liability
To the fullest extent permitted by Malaysian law:
- Arton shall not be liable for indirect, incidental, or consequential damages.
- Arton’s total liability shall not exceed the amount paid by the user for the relevant transaction.
9. Indemnification
You agree to indemnify and hold harmless Arton, its directors, employees, and partners from any claims, damages, or expenses arising from:
- Your use of the Platform
- Your uploaded content
- Your violation of these Terms or applicable laws
10. Suspension and Termination
Arton may suspend or terminate access to the Platform at any time if:
- These Terms are violated
- Legal or regulatory risks arise
- Platform security is threatened
Termination does not affect accrued rights or obligations.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Malaysia.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Changes to These Terms
Arton may revise these Terms from time to time.
Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
